PrivacyDear Sir/Madam, In order to comply with the obligations laid down by the legislative Decree dated 30 June 2003 ns. 196 with regard to the retention and use of personal data (cd. Code of Privacy) which came into effect on the lst January 2004, with this communication we would like to inform you that the Associazione per la Tutela e Valorizzazione del Patrimonio Gastronomico Cucinario Tipico d’Italia (hereon in, “the Association”) with its head office in Piazza Aldrovandi 2/2, 40125 Bologna P.IVA 02456601208 will retain personal data that you have supplied to us. The retention and use of personal data will be carried out within the rules in force and according to the following conditions: 1.= The purpose of data retention The retention and use of personal data, including photographic material, is directly related to the following: a) for operational, managerial and bookkeeping needs, limited to the Association; b) for strategic communication and operational marketing aims. 2.= Method of data retention and use The retention of data, including photographic material, can consist of, other than in its collection, in its recording, organization, maintenance, consultation, elaboration, use, modification, cancellation, interconnection, comparison, communication, diffusion, etc. and will be carried out in both paper form and also with the aid of computerised data collection equipment, according to the aim and with tools capable of guaranteeing the safety and the preservation of the data, in compliance with Article 31 and following the D. Lgs. 196/2003, which is related to the "minimum safety measures required for the retention and use of personal data." In particular, all technical measures will be adopted such as computer science, organizational, logistical and procedural safety techniques as required by the D.lgs. 196/2003 and Addendum B to the same decree, in order that the basic level of data protection required by the law is guaranteed. Besides these applied methodologies we guarantee that access to the data is permitted only to those Association personnel entrusted with its retention and use. 3. = Conferment of data The conferment of data is: a) Obligatory whereas expressly requested by law or by other binding rules; b) Optional in all other cases. Nevertheless, the conferment of all data required by the Association (personal statistical data, information on life habits, information on possible intolerances and/or food allergies, photographic material) is necessary for the complete and correct commencement and execution of the relationship initiated with you. An eventual refusal to furnish the data of which, in whole or in part, is legitimate could jeopardize the carrying out of the relationship with our Association and, in particular, could render it impossible for us to carry out your instructions as well as effecting the performance of the services requested and their relative invoicing. 4. = Communication and diffusion of data External communication of personal data collected for the purposes in point number 1 can only occur where: a) Such communication is obligatory to assure compliance to the requirements of the law or of other regulatory constraints; b) Such communication is obligatory to assure the correct establishment and continuation of the business relationship between you and the Society. The personal data collected for the above purposes may be communicated to public and private entities, single individuals and/or associations, juridical and/or commercial bodies and/or management of information systems and/or payment systems, including external entities that have been given specific assignments on behalf of our Society. In particular data can be communicated to the following categories of business: commercial entities, banking institutes and specialized societies in the management of payments, legal and consulting offices, personnel entrusted with the revision of the Society’s budget, public authorities or administration for the fulfilment of the law, Italian and foreign suppliers, finance and transport societies, third parties entrusted with the control of the quality of the commercial-logistic flow, as well as other societies which are part of our Group. The data, including photographic material, can be published on the internet website of the Association www.homefood.it as well as used in the management activity and promotion of the Association through the mass media. 5. = Overseas transfer of data Within the necessary strict limits of the execution of the associative relationship with you which is in force, your personal data can be communicated to third parties (generally partners of the Association) situated overseas, whether inside or outside the European Union. 6. = The party's rights According to Article 7 of the D. Lgs. 196/2003, you have the right: a) to obtain confirmation of the existence or inexistence of your personal data and its communication in an intelligible form; b) to obtain, edited by the holder of or the person responsible for the retention and use: b1) information on the origin of the personal data, on the purpose, retention and use of data, the method applied in the case of retention with the aid of electronic tools; b2) information on the identifying details of the Holder of and designated others responsible for the information; b3) information concerning the entities or categories of entity to whom the data can furnished and/or communicated as the responsible, entrusted designated territory of state representative. c) to obtain: c1) the update, rectification or integration of your data; c2) the cancellation, the transformation into anonymous form or the blocking of data retained in violation of the law, including that for which maintenance is not necessary for the purpose for which the data has been collected or subsequently retained; c3) the attestation of the fact that the operations referred to in the preceding points c1) and c2) have been communicated, also with regard to their content, those people to whom the data has been communicated or diffused, except in the case where such fulfilment renders it impossible or requires the employment of disproportionate means in comparison to the protection afforded. d) to oppose, in whole or in part: d1) for legitimate reasons, the retention and use of your personal data also pertinent to the purpose of its collection; d2) the retention and use of your personal data for commercial information purposes or the sending of advertising material or direct selling or for market research purposes or commercial communication. The preceding rights can be exercised both directly and through your designated representative according to Arts. 8 and 9 of the D.lgs. 196/2003. 7.= The Holder of and person responsible for the retention and use of personal data The sole Holder responsible for the retention and use of personal data is the Associazione per la tutela e valorizzazione del patrimonio gastronomico cucinario tipico d’Italia, Piazza Aldrovandi 2/2, 40125 Bologna (Italy), in person of its legal representative Prof. Egeria Di Nallo.
8. = Consent to the retention and use of personal data: Finally we would like to inform you that the retention and use of your personal data by the method and for the reasons illustrated above is optional. In the case of your denial of consent, our Society will not be able to retain your personal data, but only to use it in compliance of the obligations of the law or of other regulations in existence, with the possible consequences described in point 3 above. ******
As already stated the D. Lgs. 196/2003 ensures that the retention and use of personal data is effected with the consent of the person concerned, with the exception of those cases specifically indicated by the same law. For this reason, we ask you to return the consent form to us by fax to 051/220797 as soon as possible, to confirm your receipt of the information contained in this informative letter, as well as the expression of your consent or denial to the retention and use of your personal data.
